Introduction

NVL Leasing & Financing's ("NVL") ongoing commitment to protect the privacy and confidentiality of your personal information is addressed in this Privacy Statement. This Privacy Statement applies in Canada and is compliant with and governed by Provincial and/or Federal Privacy Legislation.

This Privacy Statement applies to the personal information of any identifiable individual that NVL collects, uses or discloses in the course of its commercial activities.

What is Personal Information?

Personal Information is information that is collected by NVL and which specifically identifies you as an individual and that allows us to provide financial services to you. If you are an employee of an organization, it does not include your name, title, business address or business phone number.

Employee's Responsibilities

Our employees are responsible for protecting the confidentiality of your Personal Information. All employees are required to sign a confidentiality agreement as part of their employment, are educated about our privacy practices and are trained how to protect your Personal Information.

In order to protect your Personal Information, NVL employees are not to disclose any of your Personal Information without first identifying and verifying your identity prior to releasing any details.

Accountability

NVL is responsible for your Personal Information under its control, possession or custody.

Identifying Purposes

We obtain Personal Information about you from yourself and, with your consent, we may also obtain financial information about you from other service providers.

The purposes for which we collect Personal Information are disclosed at the time you provide your consent for us to do so.

Only authorized NVL employees and authorized service providers will have access to your file, unless otherwise required by law.

We request your Personal Information so that we can provide financial services to you as well as to maintain commercial relations with our customers, to identify customer needs and to administer and manage our business operations.

NVL may contact their customers from time to time to advise them of the development and implementation of customer programs that we may offer and that you may qualify for. In order to do so, NVL may use the Personal Information on file to determine if you qualify for such customer programs.

Why we ask for Your Social Insurance Number ("SIN")

We ask that you provide us with your SIN to ensure that there is a match between your Personal Information and your credit bureau information and to verify the accuracy and completeness of the information we obtain.

Consent

Your knowledge and consent is required for the collection, use or disclosure of your Personal Information.

You may choose not to provide us with some, or all, of your Personal Information, although in most circumstances, certain Personal Information may be required in order to provide you with financial services.

You may choose to withdraw your consent in its entirety or to a particular use or disclosure. However, such use and disclosure of your Personal Information may be required so that NVL can monitor and/or enforce various contractual obligations and your consent is required so that NVL can provide its services to you. In such situations, NVL may not be able to fulfill your request to withdraw your consent or, provide you with financial services if you choose to limit the personal information you provide or wish to withdraw your consent.

Under Privacy Legislation, NVL may disclose your Personal Information without your consent in certain circumstances such as:

To our lawyers;
To a Police Force and/or all other persons authorized by law;
To Government Agencies which can oblige us to do so;
In emergency situations, where the life, health or safety of a customer is in danger;
To a service provider retained by NVL in relation to the administration or collection of your account and who has satisfied NVL that their operational procedures are compliant with any applicable Privacy Legislation.

Limiting Collection

NVL only collects Personal Information required to deliver financial services to you, such as:

Full legal name, address and phone numbers;
Length of time at current address;
Marital status;
Gender;
Drivers License information;
Confirmation of employment and salary/wages;
Length of time at current employment;
Social Insurance Number;
Date of birth; and
Banking/Financial information (i.e rent, mortgage, etc.).

We do not use misleading or fraudulent techniques to collect Personal Information from or about you.

Limiting Use, Disclosure and Retention

NVL does not use or disclose your Personal Information for any purposes other than those for which it was collected, except with your consent, or in the following circumstances:

To our lawyers;
To a Police Force and/or all other persons authorized by law;
To Government Agencies which can oblige us to do so;
In emergency situations, where the life, health or safety of a customer is in danger;
To a service provider retained by NVL in relation to the administration or collection of your account and who has satisfied NVL that their operational procedures are compliant with any applicable Privacy Legislation.

Some of NVL's service providers may be located outside of Canada. As a result, your Personal Information may be accessible to regulatory authorities in accordance with the law of such jurisdictions.

Your Personal Information is retained for as long as is necessary to fulfill the purpose for which it was collected.

Accuracy

Your Personal Information is kept as accurate, complete and up to date as is necessary for the purposes for which it was collected. To be able to do so, NVL requires notification of any changes to your Personal Information such as address and phone numbers.

NVL regularly updates your credit bureau to provide accurate and up to date reporting relative to the financial services provided to you.

Safeguards

NVL protects your Personal Information in its control against loss, theft, unauthorized access, disclosure, copying, use or modification by implementing physical, organizational and technological security measures.

NVL also has established procedures and controls in place relative to the destruction, deletion and overall disposal of your Personal Information when it is no longer required for the purposes for which it was collected.

Retention of Personal Information

NVL will only keep your Personal Information for as long as it is needed. The length of time is dependent upon,

The type of financial service you have with us; and
Legal or legislative requirements.

Openness

NVL will accept any inquiries relative to its Privacy practices, which are not addressed in this document. All inquiries should be directed to the Finance Manager. NVL will provide its Privacy Statement in an alternative format to requesting individuals with sensory disabilities.

Accessing your Personal Information

Upon receiving a written request, we will inform you of the existence, use and disclosure of your Personal Information.

If you have any questions regarding your Personal Information in NVL's file, you can write to the Finance Manager with your full name, address and phone number(s).

NVL will use its best efforts to reply to a request for access to a file as soon as possible and within a maximum of 30 days. NVL may refuse access to a file in the following circumstances:

If it is deemed costly to provide;
Contains references to other individuals;
Cannot be disclosed for legal or security reasons;
Subject to solicitor-client or litigation privilege.

Challenging Compliance

Questions and concerns regarding our Privacy practices can be addressed to the attention of the Finance Manager.

NVL may make changes to this Statement from time to time, all of which will be posted at www.nvl.ca so that you are able to access the most recent version of this Statement at any time.
